HOME FARM: The Orchards property was a producing cherry orchard, which had outlived its usefulness. The trees were old and needed replacement. The orchard was owned and maintained for many years by the Olmstead family. Lee Olmstead, the prior owner, decided to retire from farming and he now spends a majority of his time in the Upper Peninsula of Michigan.

SITE CONDOMINIUM: The Orchards was developed as a site condominium under the Michigan Condominium Act. It looks like a subdivision. A unit owner in the site condominium may build a custom home in his or her unit or may simply retain the unit without building. Home design is controlled by restrictions set forth in the master deed. An association of all unit owners has been established to enforce the restrictions and other rules and regulations found in the master deed. If a unit owner is in violation of the master deed, the association has the power to remedy the violation and pass on the related cost to the offending unit owner. If the offending owner refuses to pay, the association may place a lien on the unit. A site condominium is much like a subdivision with restrictions, except the restrictions are generally easier to enforce.
Condominium development in Michigan is governed largely by the Michigan Condominium Act. “Condominium” is a form of real property ownership. Under Michigan Law, a condominium unit (i.e. that portion of the condominium individually owned and occupied) has the same legal attributes as any other form of real property and may be sold, mortgaged or leased, subject only to the restrictions contained in the master deed and related condominium documents. Each owner receives a deed to his or her individual condominium unit.
Condominiums in general are divided into three types of property; the units themselves, limited common elements and general common elements. A unit at The Orchards defines the area in which a home may be built. The yard area from the unit to what would be the lot lines in a subdivision is a limited common element and is reserved for the exclusive use of the unit owner. General common elements include the utility easements and common areas, and may be used by every unit owner. Rules, regulations and restrictions are detailed in the master deed, and enforced by the condominium association.
The foregoing is only a generalized and simplified discussion of the condominium process. It is not a substitute for reading the condominium documents themselves, including, in particular, the disclosure statement, which is furnished to all purchasers.
RESTRICTIONS: To assure quality development of the homesites at The Orchards, a comprehensive set of restrictions has been included in the master deed. These restrictions are summarized below:
Roads: All roads in the development have been dedicated to the Leelanau County Road Commission. Road maintenance, including snow plowing, is the responsibility of the Road Commission.
Building Footprints: Each unit at The Orchards describes the area in which the house can be built. Water wells, septic systems and driveways may be positioned outside the unit’s boundaries, but within the limited common element.
Allowable Trimming: Any growing tree that exceeds fifteen inches in circumference cannot be removed unless it is within the construction envelop of the house, driveway, septic system, etc.
Design: Home design must adhere to the “natural” philosophy of architecture, requiring the use of natural materials, such as wood, stone or brick, or high quality vinyl siding, in a manner which integrates such materials with the environment, and which contributes to the overall beauty and naturalness of the condominium and is so related to the topography as to become a compatible, coherent part of the existing landscape.
Construction:
- Only single-family residences; one house per unit.
- Exterior materials: wood, wood shingles, wood siding, brick, stone or high quality vinyl siding.
- Minimum size: Single floor dwellings must have a minimum of 1,500 square feet of habitable area, exclusive of basements, garages, patios and porches. Multiple story dwellings must have a minimum habitable building footprint of 1,000 square feet and a total minimum habitable area of 1,800 square feet, exclusive of basements, garages, patios and porches.
- One outbuilding (300 to 1,200 square feet) is allowed per unit.
- Building plans must be approved, in writing, by the association.
Common Areas: All common areas are for the use and enjoyment of co-owners (and their guests) within The Orchards.
Water Wells: Water wells have been drilled on each homesite. The homeowner need only to install a pump and related piping.
Septic Systems: Requirements vary depending on the unit. See the master deed for detail.
Association Dues: $100.00 annually.
