thepointsThe Points is a small, residential community of one-acre homesites located between Suttons Bay and Traverse City, overlooking Grand Traverse Bay.

OVERVIEW: The Points is a 21-unit residential site condominium, just three miles south of Suttons Bay. Each homesite is over one acre in size. A building footprint has been established for each lot to assure everyone a view of the Bay. Building footprints are approximately 4,900 square feet allowing significant latitude in locating the homes. Underground electric, natural gas and telephone service is provided to each site. The project is approved by the county health department for on-site septic and water wells.

THE NAME: What’s in a name? In real estate, it is very important. From The Points, there are unobstructive views of Grand Traverse Bay from Charlevoix on the north to Power Island (Marion Island) on the south. Along this expanse are five points of land clearly visible from The Points — Omena Point, the backside of Stoney Point, Old Mission Point, the buoy at Lee Point and Neau-Ta-Wanta Point. The Points seemed to be a natural description.

HOME FARM: The Points property is steeped in history. In 1938, Samuel Bareham purchased the property so his son Virgil could fulfill a lifetime dream of working the soil. Virgil grew corn and potatoes along with cherries. He also raised cattle and horses. Virgil officially purchased the property in 1950 and he and his wife Ester have produced cherries ever since. Virgil’s love of the land is still evident at The Points. Over the years, he planted white pine, red pine and various species of spruce along the property lines. These natural buffers will be protected at The Points. During their possession of the property, the Barehams raised six children. They are now grown and scattered throughout Michigan and the United States. Since none of the children showed a desire to continue the family cherry business, Virgil and Ester decided to dispose of the property. Mr. Beeler, the developer, was fortunate to be in the right place at the right time, and purchased the property in mid 1991. When designing The Points, it was very important to Mr. Beeler to retain the Bareham influence. Some cherry trees have been retained in a common area along Donnybrook Road. Walden Court (named after Henry David Thoreau’s Walden Pond) has been tucked away in a natural ravine making it disappear from view. Spinnaker Lane meanders east and west through the property affording magnificent views of Grand Traverse Bay.

THE DEVELOPER: The developer of The Points is Tom Beeler, president of Timberline Enterprises, Inc. Tom’s philosophy of development is to preserve the natural beauty of the site and enhance areas of special interest.

SITE CONDOMINIUM: The Points was developed as a site condominium under the Michigan Condominium Act. It looks like a subdivision. A unit owner in the site condominium may build a custom home in his or her unit or may simply retain the unit without building. Home design is controlled by restrictions set forth in the master deed. An association of all unit owners has been established to enforce the restrictions and other rules and regulations found in the master deed. If a unit owner is in violation of the master deed, the association has the power to remedy the violation and pass on the related cost to the offending unit owner. If the offending owner refuses to pay, the association may place a lien on the unit. A site condominium is much like a subdivision with restrictions, except the restrictions are generally easier to enforce.

Condominium development in Michigan is governed largely by the Michigan Condominium Act. “Condominium” is a form of real property ownership. Under Michigan Law, a condominium unit (i.e. that portion of the condominium individually owned and occupied) has the same legal attributes as any other form of real property and may be sold, mortgaged or leased, subject only to the restrictions contained in the master deed and related condominium documents. Each owner receives a deed to his or her individual condominium unit.

Condominiums in general are divided into three types of property; the units themselves, limited common elements and general common elements. A unit at The Points defines the area in which a home may be built. The yard area from the unit to what would be the lot lines in a subdivision is a limited common element and is reserved for the exclusive use of the unit owner. General common elements include the utility easements and common areas, and may be used by every unit owner. Rules, regulations and restrictions are detailed in the master deed, and enforced by the condominium association.

The foregoing is only a generalized and simplified discussion of the condominium process. It is not a substitute for reading the condominium documents themselves, including, in particular, the disclosure statement, which is furnished to all purchasers.

RESTRICTIONS: To assure quality development of the homesites at The Points, a comprehensive set of restrictions has been included in the master deed. These restrictions are summarized below:

Roads: All roads in the development have been dedicated to the Leelanau County Road Commission. Road maintenance, including snow plowing, is the responsibility of the Road Commission.

Building Footprints: The outline adjacent to each unit number at The Points describes the area in which the house can be built. These footprints are a minimum of approximately 4,900 square feet. Wells, septic systems and driveways may be positioned outside the unit’s boundaries, but within the limited common element.

Allowable Trimming: Any growing tree that exceeds fifteen inches in circumference cannot be removed unless it is within the construction envelop of the house, driveway, etc. All trees may be trimmed with approval of the association.

Design: Home design must adhere to the “natural” philosophy of architecture, requiring the use of natural materials, such as wood, stone or brick, in a manner which integrates such materials with the environment, and which contributes to the overall beauty and naturalness of the premises and is so related to the topography as to become a compatible, coherent part of the existing landscape.

Construction:

  • Only single-family residences; one house per unit.
  • Exterior materials: wood, wood shingles, wood siding, brick or stone.
  • Cost: Equivalent of $85.00 per square foot of habitable space using 1991 value.
  • Minimum size: 1,800 square feet of habitable area, excluding conventional basement.
  • Building plans must be approved, in writing, by the association.
  • No co-owner may construct or cause to be constructed a wall or fence, plant vegetation or in any way obstruct the water view of any other co-owner.

Common Areas: All common areas are for the use and enjoyment of co-owners (and their guests) within The Points. These areas must remain in their natural state.

Septic Systems: Requirements vary depending on the unit. See the master deed for detail.
